These terms are the rules for using His 75. The short version: be at least 18, use the app lawfully, respect other people, and make health decisions that are right for you.

1. Agreement

These Terms of Service form an agreement between you and Frederick James Dev Limited (company number 17198937), the operator of His 75 (“His 75”, “we”, “us”). They apply to the His 75 iOS app, website and related services.

By downloading, purchasing, accessing or using His 75, you agree to these terms and our Privacy Policy. If you do not agree, do not use the service. You must be at least 18 and legally capable of entering this agreement.

2. The service and your licence

His 75 provides habit-planning, progress tracking, optional proof photos, social accountability and related tools. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose in accordance with these terms and Apple’s applicable usage rules.

You are responsible for your compatible device, internet access, App Store account and any charges from your network provider. Features may vary by region, device, subscription or product version.

3. Your profile and access

The app may identify your installation with a random identifier and allow you to create a profile or share code. Keep your device and access details secure. You are responsible for activity carried out through your installation or profile unless caused by our breach.

Provide accurate information, do not impersonate anyone, and tell us promptly at freya@frederickjames.net if you suspect unauthorised use.

4. Subscriptions, trials and payment

  • Paid access is offered through Apple in-app purchase. Available plans, price, billing period and any trial are shown before you confirm a purchase.
  • Payment is charged to your Apple Account. Subscriptions automatically renew unless cancelled through your Apple Account settings. Cancellation normally takes effect at the end of the current paid period.
  • Apple handles billing, cancellation and eligible refunds under its rules. We do not receive your full card details. You can manage your plan in the app’s subscription screen or in iOS Settings.
  • Prices and plans may change. Apple will provide any notice or obtain any consent required for a renewal price change.
  • If a free trial is offered, cancel at least 24 hours before it ends if you do not want the paid subscription to begin.

Nothing in this section limits refund or cancellation rights that cannot legally be excluded.

5. Your content

You keep ownership of photos, messages, profile details, tasks and other content you submit (“User Content”). You give us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, process, moderate and display that content only as needed to operate, secure, improve and provide the service, comply with law, and carry out the sharing choices you make. This licence ends when the content is deleted from our systems, except for limited backup, legal or safety retention.

You confirm that you have the rights needed to submit User Content and that it does not violate law, privacy, publicity, confidentiality or intellectual-property rights. Do not upload someone else’s image or personal information without permission.

Social features make content visible to other people according to the feature you use. Think carefully before sharing. We cannot control what another user does with content they can view.

6. Acceptable use

You must not:

  • harass, threaten, exploit, deceive or impersonate another person;
  • post unlawful, hateful, sexually exploitative, violent, dangerous or infringing content;
  • encourage self-harm, eating disorders, unsafe exercise or other dangerous behaviour;
  • use the service for spam, unsolicited promotion, fraud or commercial scraping;
  • probe, bypass, disrupt or misuse security, moderation, access controls, APIs or infrastructure;
  • reverse engineer the app except where applicable law expressly permits it; or
  • help anyone else do any of the above.

We may use automated tools and human review to moderate content. We may reject or remove content, limit features, suspend access, preserve evidence or report conduct where reasonably necessary for safety, legal compliance or enforcement. You can report users in the app and contact us if you believe a decision was mistaken.

7. Health and safety

His 75 is a habit and accountability tool, not a medical, mental-health, nutrition or fitness service. It does not diagnose, treat or prevent any condition and does not replace professional advice.

You choose your own challenge and activities and are responsible for deciding whether they are safe and suitable. Consider your health, experience and environment; use appropriate equipment; rest when needed; and seek advice from a qualified professional before beginning a demanding routine, particularly if you have a medical condition, injury, are taking medication or have concerns about diet or exercise.

Stop and seek appropriate help if you feel pain, dizziness, distress or other concerning symptoms. In an emergency, contact local emergency services. Never use the app in a way that distracts you while driving or doing anything requiring full attention.

8. Our intellectual property

His 75, including its software, design, branding, text, graphics and non-user content, is owned by us or our licensors and protected by law. These terms do not transfer that ownership. Feedback you voluntarily provide may be used by us without restriction or payment, but we will not identify you publicly without permission.

9. Third-party services

The service depends on third parties including Apple, RevenueCat, Convex, Cloudflare and OpenAI. Their own terms and privacy notices may apply to their services. We are not responsible for third-party services outside our reasonable control, but this does not affect responsibility we cannot exclude by law.

10. Changes, availability and termination

We may add, remove or change features, update technical requirements, or suspend parts of the service for maintenance, security, legal or operational reasons. We do not promise that the service will always be available or error-free.

You may stop using His 75 at any time and can delete account data through the in-app Delete Account control. Deleting the app does not cancel an Apple subscription; cancel it separately in your Apple Account settings.

We may suspend or terminate access where you materially or repeatedly breach these terms, create risk or harm, or where required by law. Where appropriate, we will give notice and a reasonable opportunity to appeal or remedy the issue.

11. Warranties and liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights.

Subject to that, His 75 is provided on an “as available” basis. We are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for loss caused by events outside our reasonable control, your unsafe choices, your breach of these terms, or content and conduct of other users.

The service is supplied for personal and non-commercial use. We are not liable for business losses such as lost profit, revenue, opportunity or business interruption. If defective digital content supplied by us damages a device or other digital content because we failed to use reasonable care and skill, we will repair the damage or pay compensation as required by law.

12. Governing law and disputes

These terms are governed by the laws of England and Wales. The courts of England and Wales have jurisdiction, except that if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts, and consumers elsewhere keep any mandatory protections and forums provided by local law.

Please contact us first so we can try to resolve a concern informally.

13. General

If a provision is unenforceable, the rest remains effective. A delay in enforcing a right is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a reorganisation, financing or sale provided your rights are not reduced. These terms, the Privacy Policy and purchase information shown at checkout form the agreement about the service.

We may update these terms to reflect product, legal or security changes. We will post the new effective date and give reasonable notice of material changes. If you do not agree to a material change, stop using the service and cancel any subscription before its next renewal.
